1.1 These Terms of Use govern your access to and use of www.twistedworks.com and any subdomains, the Website.
1.2 These Terms apply only to the Website. They do not govern our games, game accounts, purchases, online services, publisher or platform services, or any other products. Those have separate terms presented in product or store contexts.
1.3 By accessing or using the Website, you agree to these Terms. If you disagree, do not use the Website.

3. Accessing the Website
3.1 Access is provided on a temporary basis. We may withdraw, suspend, or change the Website without notice. We are not liable if the Website is unavailable at any time or for any period.
3.2 We do not offer public user accounts on the Website. If we provide you with any credentials or access controls for restricted areas, you must keep them confidential and must not share them. We may disable credentials if you breach these Terms.
3.3 You are responsible for making all arrangements necessary to access the Website and for ensuring that all persons who access the Website through your connection comply with these Terms.

4. Permitted use and prohibited use
4.1 You may use the Website only for lawful purposes and in accordance with these Terms.
4.2 You must not:
a. copy, reproduce, republish, frame, mirror, sell, resell, or exploit any part of the Website for commercial purposes without our prior written licence
b. access the Website through any automated means for the purpose of scraping, harvesting, or mass downloading content or data
c. introduce or upload any material that contains viruses, worms, trojans, spyware, or other harmful code
d. attempt to gain unauthorised access to the Website, the server on which it is stored, or any server, computer, or database connected to the Website
e. attack the Website by denial of service or distributed denial of service
f. reverse engineer, decompile, or otherwise attempt to derive the source code of any software that forms part of the Website, except where permitted by law.

5.1 The Website and its content are owned by Twisted Works Ltd or our licensors and are protected by copyright and other intellectual property laws.
5.2 All company names, brand names, trademarks, logos, illustrations, videos, and other intellectual property that are not owned by Twisted Works remain the property of their respective owners.
5.3 You must not use any part of the Website content for commercial purposes without a licence from us or our licensors. If you print, copy, or download any part of the Website in breach of these Terms, your right to use the Website ceases immediately and you must return or destroy any copies you have made.

6. Changes to the Website
6.1 We may update the Website and its content at any time. Content may be out of date at any given time and we are under no obligation to update it.

7.1 Commentary and other materials on the Website are for general information only and are not advice. We disclaim all liability arising from any reliance placed on such materials.

8.1 The Website and its content are provided without guarantees, conditions, or warranties as to accuracy or completeness.
8.2 To the extent permitted by law, we exclude all conditions, warranties, and other terms which might otherwise be implied by statute, common law, or equity.
8.3 We exclude liability for any loss or damage, direct or indirect, arising in connection with the Website or its use, inability to use, or results of use, any websites linked to it, and any materials posted on it. This includes, without limitation, loss of income or revenue, business, profits or contracts, anticipated savings, data, goodwill, and wasted management or office time.
8.4 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

9. Security, viruses, and offences
9.1 You must not misuse the Website by introducing malicious or technologically harmful material.
9.2 Breach of this clause may be a criminal offence under the Computer Misuse Act 1990. We will report breaches to law enforcement and will cooperate by disclosing your identity.
9.3 We are not liable for loss or damage caused by distributed denial of service attacks, viruses, or other harmful material that may infect your equipment due to your use of the Website or your downloading of material from the Website or any website linked to it.

10. Linking to the Website
10.1 You may link to the Website home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
10.2 You must not establish a link in a way that suggests any association, approval, or endorsement on our part where none exists.
10.3 You must not frame the Website on any other site.

11. Links from the Website and third-party embeds
11.1 Where the Website contains links to other sites and resources provided by third parties, these links are for information only. We have no control over the content of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.
11.2 Third-party embeds, for example, video players or social media widgets, are provided by their operators and are subject to the operators’ terms and privacy policies.

12. Unsolicited ideas
12.1 Twisted Works does not solicit or accept unsolicited ideas or materials. This applies to submissions made through the Website, by email, via social media or any third party platform, at events, or by any other means, each a Submission. If you do not agree to this clause, do not make a Submission.
12.2 By making a Submission, you irrevocably assign to Twisted Works, with full title guarantee, all right, title, and interest in and to the Submission and all associated intellectual property rights, worldwide, perpetual, royalty free, fully paid up, transferable, and sublicensable. This assignment includes all rights to exploit, use, reproduce, modify, adapt, translate, create derivative works, perform, display, publish, distribute, make available, manufacture, market, and sell, in any form or media now known or later developed.
12.3 To the fullest extent permitted by law, you waive, and agree not to assert, any moral rights or similar rights you may have in the Submission. Where a waiver is not effective, you agree not to enforce those rights against Twisted Works or its licensees or successors.
12.4 If and to the extent any assignment in clause 12.2 is not effective under applicable law, you grant Twisted Works an exclusive, perpetual, irrevocable, worldwide, royalty free, fully paid up, transferable, sublicensable licence to exercise all rights in the Submission described in clause 12.2.
12.5 No confidentiality. Submissions are non confidential and non proprietary. No fiduciary or confidential relationship is created by your Submission. Twisted Works has no obligation to review, keep, acknowledge, return, or respond to any Submission.
12.6 No obligation or compensation. You are not entitled to any payment, credit, acknowledgement, approval, or notice for any use of a Submission.
12.7 Independent development. Twisted Works may already be developing, may in future develop, or may acquire materials or ideas that are identical or similar to a Submission. You agree that this may occur without any obligation to you and without any restriction. No implied contract arises from receipt, review, or use of a Submission.
12.8 Further assurances. You agree to execute documents and do all acts reasonably requested by Twisted Works to perfect, record, or enforce the assignment or licence granted under this clause, including the execution of further assignments and consents. You appoint Twisted Works as your attorney in fact to execute such documents if you do not do so, solely to effect the purposes of this clause.
12.9 Warranties. You represent and warrant that you have the right to make the Submission, that the Submission is original to you or you otherwise have all necessary rights, and that the Submission does not infringe, misappropriate, or violate any third party rights.
12.10 No claims. You agree not to assert, and not to assist any third party to assert, any claim against Twisted Works or its affiliates, licensees, or successors in relation to a Submission or the use of similar or identical ideas, content, or materials.
12.11 Exceptions. If Twisted Works wishes to consider a Submission, it will contact you and any consideration will be subject to a separate written agreement signed by both parties. That written agreement will govern instead of this clause for the specific Submission.
12.12 Survival. This clause survives termination of these Terms and your use of the Website.

13. Changes to these Terms
13.1 We may revise these Terms at any time by amending this page. Changes are binding on you from the date of publication.

14. Language
14.1 These Terms are in English. Where a translation differs, the English version controls, subject to any mandatory local consumer protections.

15. Miscellaneous
15.1 Severability: If any provision is held invalid, the remaining provisions remain in full force and effect.
15.2 No waiver, failure to enforce a provision is not a waiver of that provision.
15.3 Assignment, we may assign or transfer our rights and obligations under these Terms. You may not assign or transfer your rights without our prior written consent.
15.4 Entire agreement: These Terms constitute the entire agreement between you and us relating to your use of the Website.

16. Governing law and jurisdiction
16.1 These Terms and any dispute or claim arising out of or in connection with them or their subject matter are governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales have exclusive jurisdiction.
